Deciding to not take any action at this point does not mean that one gives up their right to take action later, at a time and place where they're ready. While there are legal ‘expiry dates’ after which one cannot take any procedural action, it doesn’t prevent taking any other actions to heal. However, it is a good practice to consult a lawyer even if the ‘expiry date’ has passed: they may be able to offer advice on whether there are routes to take action.
